GENERAL TERMS OF USE
Please read these CGU carefully before using the Site. The User may not use the Site if they do not accept these Terms.
ARTICLE 1: ACCEPTANCE AND MODIFICATION OF THE GENERAL TERMS OF USE
The general terms of use of the platform (hereinafter "CGU") aim to define the conditions of access and use of the platform and its services. The user is aware that the platform's CGU may be modified at any time and unilaterally by Ventagli Camurati, in order to comply with any developments in its services or legal, jurisprudential, editorial, and/or technical changes. Ventagli Camurati commits to informing the user of any changes made to its services and/or its CGU via email or through information published on the platform.
The user is reminded of their duty to consult the latest version of the Terms of Use (CGU) available on the platform before submitting any new order.
ARTICLE 2: CONDITIONS AND METHODS OF ACCESS TO THE PLATFORM
The platform is freely accessible to all users at "www.ventaglicamurati.com". The user must have an internet connection.
All software and materials necessary for the use and functioning of the platform's services or internet connection are the user's responsibility. They are solely responsible for the proper functioning of their computer equipment and internet connection.
The user will be able to access, consult, or use the entire platform or part of it. The user may also subscribe to the Ventagli Camurati newsletter.
To purchase products on the platform, the user must be:
- a natural person of legal age and capable of acting;
- a legal entity whose legal representative is required to mention: valid information regarding its identity (surname, name), its company name, its tax code and VAT number or its REA number, the address of its registered office, its phone number, and its email address and/or certified email (PEC/Posta Elettronica Certificata).
the user agrees to provide data that allows for their identification under their total responsibility, control, and direction and agrees to communicate complete, accurate, and updated information and not to impersonate third parties or conceal or modify their age.
Additionally, the user agrees to:
provide authentic, accurate, and complete information regarding their identity, address, and other data necessary for accessing the platform to avoid misleading Ventagli Camurati or sellers or third parties;
- update the aforementioned information in case of any changes;
- not access a personal account related to another user;
adopt all necessary measures to protect his identifiers, password, and data from any violations.
Ventagli Camurati reserves the right to suspend or deny access, without notice or compensation, temporarily or permanently, to the entire platform or part of it and/or its services and content, in case of serious, single and/or repeated violations of the provisions of these Terms of Use by the user, including, but not limited to, the submission of false, inaccurate, incomplete, or outdated data or in case of use of fraudulent payment methods, attempts at fraud, or any other crime.
ARTICLE 3: USER CONDUCT
The user declares and acknowledges that all information, data, texts, messages, and other content published by him on the platform (hereinafter "contribution") is under his exclusive responsibility.
The user agrees not to publish contributions that are contrary to applicable laws and regulations.
In particular, the user may not:
disseminate information contrary to public order or good morals,
deviate from the purpose of the platform and/or services for propaganda or proselytism, prospecting, or solicitation,
publish conventional commercial, advertising, or propaganda information for tobacco, alcohol, or other regulated substances, products, or services,
disseminate publications that violate the personality rights of third parties or that are defamatory, slanderous, obscene, pornographic, offensive, violent, or that incite discrimination, political, racist, xenophobic, sexist, or homophobic violence,
publish information that violates personal data protection legislation, allowing the identification of individuals without their consent, such as last name, postal and/or email address, phone number, photos, audio or audiovisual recordings, or collect and store personal data related to other users,
fraudulently access the platform and services contrary to what is stated in the platform's terms of use,
send messages containing computer viruses or other codes, folders, or programs designed to interrupt, destroy, or limit the functionality of software, computers, or telecommunications tools,
harass in any way one or more users,
- provide information that refers to other sites (via links or simply providing information), the content of which may violate applicable laws or regulations and compromise the rights of individuals and property and/or intellectual property rights.
Furthermore, the user may not violate the intellectual property rights of third parties. The user agrees to comply with applicable laws and regulations and to use only content for which they hold the rights or for which the rights holder has provided explicit consent for dissemination or that are free from all rights.
Where necessary, the user agrees to indemnify Ventagli Camurati for any damage directly or indirectly related to the failure to comply with the aforementioned commitments.
Users who act fraudulently regarding these general terms of use will be liable civilly and criminally for any violations of copyright and related rights, rights of database producers, and rights of automated data processing systems.
Ventagli Camurati may initiate legal action against users who do not comply with these provisions.
ARTICLE 4: FINANCIAL PROVISIONS
The selling prices of products on the platform are listed in Euros, taxes included but shipping costs excluded, which will be indicated to the user during the ordering process, before definitively confirming the order.
The buyer proceeds to settle their orders directly on Ventagli Camurati according to the payment methods available on the platform.
Payment for orders placed through the platform is made to Ventagli Camurati or to payment providers who collect funds on behalf of the seller.
Orders from buyers who have not fully paid for a previous order or who are involved in a dispute related to a payment may be refused.
ARTICLE 5: DELIVERY
The buyer is required to check the condition of the products upon receipt to confirm their compliance with the order.
If product verification is possible at the time of delivery, the buyer must immediately file a complaint with the carrier if the product has been damaged during transport.
If a product is returned to the sender for the following reasons "unclaimed" or "does not reside at the indicated address":
- the buyer will be refunded the price of their order (excluding return costs of the product): and/or
- in case of disagreement between buyer and seller, the product will be returned to the buyer. The buyer is responsible for covering the related costs (return and reshipping fees)
5.1. Delay/missed delivery
In case of delay, total or partial non-receipt of the ordered product(s), the buyer must contact the seller after the agreed delivery to resolve the issue.
ARTICLE 6: RIGHT OF WITHDRAWAL
Pursuant to the Consumer Code (Legislative Decree September 6, 2005, no. 206 and subsequent amendments), the buyer is granted a period of fourteen (14) calendar days from the day of delivery of the product to exercise their right of withdrawal, without the need to provide a reason, and without incurring costs other than those provided for in Article 56, paragraph 2, and Article 57 of the Consumer Code..
Any refund will be made by Ventagli Camurati.
The right of withdrawal implies that you have changed your mind after receiving the product in good condition and want to return it to the seller for a refund.
What are the conditions to exercise the right of withdrawal?
- It is necessary to inform the seller of the intention to exercise the right of withdrawal within 14 days from the date of delivery of the product. After this 14-calendar-day period, the seller will not be able to make any replacement or refund.
- The products must not be used and show no signs of wear.
- Shipping costs will be borne by the customer.
ARTICLE 7: DAMAGED PRODUCTS
In the case of delivery of a damaged package, the buyer is encouraged to contact the seller via email to resolve the issue.
The buyer is required to check the condition of the package at the time of delivery and to notify the courier, in writing, by adding the "reservation of control" clause, of any signs of damage on the outside as well as inside the package.
Signing with reservation means that the recipient of the goods received via the courier reserves the right to verify the integrity of the merchandise and that, in case of damages resulting from transportation, the courier will be held responsible.
The courier, by law (art. 1693 CC), is responsible for damages caused to the items being transported, from the moment they receive them until the moment of delivery The buyer is encouraged to open the package in the presence of the courier and verify that the product is intact. Written notification of any damage will allow the merchant to initiate a claim against the courier.
In the case of damages not recognizable at the time of delivery, but attributable to transportation, the buyer must report the damage to the courier within eight days of receipt, under penalty of losing the right to claim damages from the carrier.
ARTICLE 8: NON-COMPLIANT, INCOMPLETE, OR DEFECTIVE PRODUCTS
In the event of delivery of a damaged, defective, incomplete, or non-compliant package, the buyer is invited to contact the seller in order to resolve the issue. The buyer must necessarily send the seller photographic documentation attesting to the damages encountered.
The seller, acting in a professional capacity, is obliged to comply with the legal and regulatory provisions related to the operation of a distance selling business.
If the sold product is found to be defective, non-compliant, or incomplete, the seller is responsible for the duration of the legal warranty (two years).
The seller is required to comply with public statements made about its products (particularly in advertisements or on labels).
Once the seller has confirmed that the received goods are indeed defective, non-compliant, or incomplete, the buyer has the right to request from the seller at no additional cost:
- the repair of the product
- the replacement of the product
- a price reduction
The buyer must first request the repair of the product or its replacement if repair is not a valid option (e.g., because it is too costly).
Another option is to grant the buyer a price reduction or a full refund, but only if the repair or replacement:
- are not possible
- would be too costly, considering the nature of the product or defect
- would cause significant inconvenience
- cannot be completed by the seller within a reasonable deadline.
ARTICLE 9: INTELLECTUAL PROPERTY
Any use, reproduction, copying, or distribution of one or more elements of the platform for purposes other than private use is prohibited.
The collection of content and services on the platform, including the domain name, texts, graphics, photographs, designs, sounds, images, audio and video, the design and organization of its pages and categories, and their titles, is protected by intellectual property rights held or claimed by Ventagli Camurati, with the authorization of the rights holders and, where necessary, its partners.
Ventagli Camurati holds trademark rights to the term “Ventagli Camurati” and the associated logo(s). Unless expressly authorized in advance, any use of the “Ventagli Camurati” trademark and other trademarks, whether figurative or not, belonging to Ventagli Camurati or third parties will make the user liable to civil and criminal prosecution.
ARTICLE 10: GENERAL PROVISIONS
User notifications, to be considered admissible, must be detailed, clearly indicate the reasons for dissatisfaction, and be sent to Ventagli Camurati via email.
Responsibility cannot be assumed for any delay or failure to perform due to a force majeure event.
